Welcome to Dev Textiles. These Terms of Service (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you,” “user,” or “distributor”), and Dev Textiles (“we," “us,” or “our”), concerning your access to and use of our direct-to-consumer (D2C) website and our Secure B2B Wholesale Portal.
Agreement to Terms
By accessing our platforms, you agree that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the site and must discontinue use immediately.
Dual-Platform Usage & Account Security
Dev Textiles operates two distinct digital environments. Your responsibilities vary depending on the platform accessed:
Available to the general public for retail purchases. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Access is strictly by application and invitation only. B2B sessions are secured via One-Time Password (OTP) authentication. You agree not to share your B2B access credentials, wholesale pricing tiers, or exclusive catalog access with any unauthorized third parties. Dev Textiles reserves the right to suspend or terminate wholesale access immediately if a breach of confidentiality is detected.
Product Representation & AI Visualization
We take immense pride in our seven-generation heritage of craftsmanship. However, due to the nature of luxury textiles:
- Handloom Variations: Slight variations in weave, texture, and dye color are hallmarks of authentic hand-crafted silks, georgettes, and traditional fabrics, and are not considered defects.
- AI Stitched Visualizer:Our digital “Visualize Stitched Look” feature utilizes artificial intelligence to provide a simulated representation of how unstitched fabrics may appear once tailored. This tool is for inspirational and editorial reference only. It does not guarantee exact final physical tailoring results, drape dimensions, or styling accuracy.
Pricing, Payments, and Taxes
Currency: All transactions are processed in Indian Rupees (INR / ₹) unless otherwise specified by an international payment gateway.
Pricing Accuracy: We reserve the right to correct any pricing errors. Wholesale (B2B) pricing is dynamic, based on your approved distributor tier, and is subject to change without prior notice.
Taxes: All applicable taxes, including Goods and Services Tax (GST) for domestic Indian orders, will be calculated and displayed at checkout. Duties and customs fees for international shipments are the sole responsibility of the buyer.
Intellectual Property & Design Protection
The Dev Textiles brand, legacy, and all associated digital content—including but not limited to textile designs, photography, editorial copy, logos, and website code—are our exclusive intellectual property.
B2B Watermarking: To protect our proprietary designs and prevent unauthorized digital replication, images viewed within the Secure B2B Portal are dynamically embedded with an invisible watermark linked to your specific Distributor ID. Any unauthorized distribution, scraping, or sharing of our digital catalog is strictly prohibited and will result in legal action.
Fabric Cuts & Return Policy
Because we deal in premium unstitched fabrics and bespoke orders:
- Standard unstitched fabrics in their original, uncut, and unaltered condition may be eligible for return strictly in accordance with our overarching Return Policy.
- Final Sale:Any fabric that has been customized, cut-to-order from a larger yardage (than a standard suit length), or physically altered in any way at the customer's request is considered a final sale and cannot be returned or exchanged.
Limitation of Liability
To the fullest extent permitted by law, in no event will Dev Textiles, its founders, directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use of the site, our products, or the inability to use our services.
Governing Law and Jurisdiction
These Terms of Service and your use of the Dev Textiles platforms are governed by and construed in accordance with the laws of India. Any legal action or proceeding related to our platforms shall be brought exclusively in the courts located in New Delhi, Delhi, and you hereby consent to the personal jurisdiction of such courts.
